Here are some new patents that Nintendo has confirmed for the 3DS. Here they are, "Nintendo has filed two patents, both of which point to possible new features that might come to the platform. The first feature would allow you to download firmware upgrades from other people's systems. This means that, for those without consistent access to the internet, a friend could download an update on their system, then transfer that update to your system. This ties in with the already-present Download Play feature.

Following on from that, the second feature would save a piece of data to your 3DS whenever you play a game via Download Play. So:

When you're done playing a game via Download Play with someone, the data is actually continually stored on your 3DS in the background so that next time you want to play, you need not re-download the whole thing."
